The South Carolina Foreclosure Process

South Carolina is a mortgage state, and that means when money is borrowed to purchase a home, the borrower promises to repay the loan by signing a Promissory Note and a lien is placed on the home in the form of a Mortgage.

If the borrower is unable to repay the loan, the lender is required to foreclose through a judicial foreclosure process in order to take ownership of the home. The judicial foreclosure process starts when the lender files a Lis Pendens. Typically, there is a 4-6 month window from when a Lis Pendens is filed to when the home is sold at the county foreclosure auction.

From www.foreclosurelaw.org: “The judicial foreclosure process is one in which the lender must file a complaint against the borrower and obtain a decree of sale from a court having jurisdiction in the county where the property is located before foreclosure proceedings can begin. Generally, if the court finds the borrower in default, they will give them a set period of time to pay the delinquent amount, plus costs. If the borrower does not pay within the set period of time, the court will then order the property to be sold.”

Once the court orders a home to be sold, the home is scheduled to be sold at a county courthouse foreclosure auction. I have been to foreclosure auctions in Charleston and Berkeley Counties, and both processes are different. When I went, Charleston County held the foreclosure auction on the courthouse steps and Berkeley County held their foreclosure auction in a courtroom. Check with your local county Clerk of Courts for their foreclosure auction process.

That is the bare bones description of the legal portion of the foreclosure process in South Carolina; however, a Lis Pendens filing is merely the first legal step in the foreclosure process and not the homeowner’s first notification of default or the lender’s first attempt to collect the mortgage (This helps you when marketing to homeowners on our Lis Pendens data lists and negotiating with lenders, which is normally a bank).

The lender begins attempting to collect missed payments as soon as the first payment is missed. Collection efforts vary by lender, but they normally include phone calls and letters. Some lenders contact the borrower as little as one week after the first missed payment.

Does that seem a little excessive to you? I agree it is. On most home loans, late fees do not start until somewhere between 15-30 days late. So why do some banks call after only 7 days?

Simple – they learned from experience. Prior to the foreclosure crisis, lenders only sent a letter or two after a borrower’s payment was 30 days past due and became a little more aggressive until the Lis Pendens was filed. During the foreclosure crisis, lenders became more active in collecting missed payments, which led them to more aggressively contacting homeowners earlier and earlier in the default process.

South Carolina October Foreclosure Report

According to RealtyTrac.com, there were 3,652 foreclosure notices (default notices, foreclosure action notices or bank repossessions) in South Carolina in October. That is 1 in every 571 housing units. That is a huge jump from September; September saw 2,690 foreclosure notices, which was 1 in every 775 housing units.

Once again, the highest numbers of pre-foreclosure homes were in the 100-200k range. The second highest segment was less than 100k. Those are bread and butter homes that give multiple exit options – wholesale, short term profit as a flip and long term hold as a rental. Today’s real estate climate has created many opportunities for Real Estate Investors and Realtors.

Business Toolkit Tool – Dropbox

Dropbox is the latest tool (and one of the greatest) I incorporated into my Business Toolkit. With Dropbox, I no longer need to carry a thumb drive, external hard drive or memory stick to manually transfer documents from one computer to another.

I am typing this blog article on my Galaxy Tab and when I return to the office and turn on my computer, this blog article will magically be there. Ok, it is not magic – it is Dropbox and their brilliant technology.

Anytime I place or update a file in the Dropbox folder on one of my computers (computer, tablet, phone, etc), the file is automatically synced to all of my other devices with a Dropbox folder. Instead of me writing how it works, check out Dropbox’s Fact Sheet -

The Pro’s of Renting to Section 8 Voucher Tenants

There are several Pro’s of Renting to Section 8 Voucher Tenants. As I mentioned earlier in the article series, I avoided Section 8 housing when I first became a Real Estate Investor. I did not like that stigma associated with it. I have since learned the Section 8 Program is an excellent tool to fill a vacancy.

I do not focus on Section 8 houses; however, the ability to rent to Section 8 Voucher Tenants has opened a few of my rental properties to a new tenant pool and improves my ability to fill my vacant properties.

Guaranteed Payment
First and foremost, the Housing Choice Voucher Program payments are guaranteed each month as long as you, the landlord, and the tenant remain in good standing with and qualify for the Section 8 Program. Yes, both of you have requirements that are to be met on a continuous basis.

To name a few: you, as the landlord, must properly maintain the home when repairs are necessary, and the tenant must maintain their financial obligations, if any, on the home. Both of the requirements ultimately benefit you. There are a few more specifics, so check with your local Section 8 authority.

Tenant Readiness Program
My local Section 8 authority has a Tenant Readiness Program, and it is mandatory for all Section 8 Voucher applicants to be considered for the Section 8 Program. The Tenant Readiness Program is “intended to prepare and give assisted housing families the tools and skill that will help them in becoming more responsible tenants and neighbors in their communities.” That quote is straight from my local Section 8 authority handout.

How great is that? Although the Section 8 Program does not qualify the applicants based on rental criteria, the Program does attempt to make them better tenants. Sounds great to me!!

Landlord Outreach Seminars
Your local Section 8 authority will help you and your home become approved for the Housing Choice Voucher Program. My local Section 8 authority offers a seminar once a year to teach landlords how to become approved to rent to Section 8 Voucher Tenants.

My local Section 8 authority wants to help me succeed, because that means the Section 8 Program will have quality homes for the families they assist.

That is a win-win situation!!

Purchase Assistance
Yes, that is right. The Housing Choice Voucher Program offers home buying assistance to Section 8 Voucher Tenants. Once the tenant has been in the home for a year, the tenant is eligible to inquire about the home buying assistance program.

None of my Section 8 Voucher Tenants have utilized this program yet, but I have a tenant that is interested in the program and is approaching the one year mark.

Not only does the Section 8 Program help find me renters, the Section 8 Program also helps find me buyers!!

If you cannot tell by now, I am a Housing Choice Voucher Program convert. There are too many positives for a landlord to not include the Housing Choice Voucher Program as a tool in your landlord tool box.

As you have learned, there are a few similarities between being a Real Estate Investor and a Private Money Mortgage Lender, and a whole lot of differences. Each one has its own set of Pro’s and Con’s.

Putting it all Together
How do you decide if being a Real Estate Investor or a Private Money Mortgage Lender is right for you?

The first step is to answer the questions that were presented in the first article. Once you know your goals and where you want to get to, you can create a path to reach them and get there.

The second step is to reread articles 2-5 and start thinking about which path will help you reach your goals.

The third step is to speak with Real Estate Investors and Private Money Mortgage Lenders. Visit your local Real Estate Investor Association, and talk with people. Learn from the individuals who are doing business in today’s market.

The final step is to take action – make a decision and move forward. If you decide the course of action you chose is not for you, you can always change gears and paths. It is called the ready, aim, fire, re-aim and fire again method. Kind of a long for a method, but it works.

Make a decision and move forward. You will never have all of the facts; therefore, you need to make the best decision you can with the information you have. As you move forward, you can adjust your actions and decisions according.
